In contemporary Britain, protest has ceased to be a fundamental right. Instead, it has become a conditional permission that authorities grant or withhold as they see fit. This represents the underlying meaning of proposed measures that the ruling administration is putting forward, which would dictate the timing and location demonstrations can take place, with potential imprisonment for those who defy these limitations.

Gradual Weakening of Civil Liberties

Earlier governments had already undermined this essential right: the former Conservative government had given law enforcement sweeping new authorities, which international human rights organizations had censured as "serious and unjustified limitations" on civil liberties. Taken together, these progressive assaults on liberty have effectively eliminated the hard-won right to public demonstration.

Using Atrocity to Justify Crackdown

The latest restrictive measures are being defended by referring to last week's terrible antisemitic assault on a Manchester Islamic center. We can all agree on universal agreement that the security of Jewish communities in Britain must be protected. However, using this horrific incident as a justification to suppress dissent is not only unrelated to that duty but perverts it.

"When you can't set boundaries at genocide, you probably cannot draw the line at democracy," observed a prominent American author, whose words that rings true for the present administration.

Historical Context of Demonstration

Reflect on Britain's rich history of protest and direct action against racial discrimination and fascism, from the 1936 Battle of Cable Street to postwar Jewish groups opposing fascism and the 1970s demonstrations against the National Front. Many of these historical demonstrators were labeled as extremists in their time, even while they were advocating the freedoms of marginalized groups.

Current Reality

In the current complex situation, here's what's actually happening: The Israeli government – a foreign state – is committing acts that international bodies have characterized as systematic destruction. Its military actions have led the global justice body to release legal indictments against Benjamin Netanyahu and his former defense minister.

Western public opinion has changed significantly against Israel's military campaign. In Britain, a substantial majority of citizens think Israel has probably committed international law violations. Most people would endorse a total prohibition on arms sales to the nation, and approve the arrest of the Israeli leader.

Suppressing Opposition

Having essentially lost the argument, pro-Israel advocates are now exploiting a despicable anti-Jewish attack to try to suppress a popular campaign against a moral catastrophe. The British government seems involved in this effort. Government officials have not enacted extensive restrictions on Israel and have allowed weapon shipments to proceed.

People who are protesting against the erasure of Gaza have been characterized as hateful extremists. Yet there's a important factor why there hasn't been a more extensive crackdown on these protesters until now: extremely few protesters have made genuinely hateful statements about Jewish people, giving police authorities little justification to intervene.

Dangerous Conflation

Equating Jewish heritage with the policies of the government of Israel is not only cynical but also harmful. The standard interpretation of anti-Jewish prejudice, adopted by the British government and numerous institutions, has been appropriately challenged for potentially restricting valid commentary of Israel. However, there should be universal agreement about one of its central illustrations: that "making Jewish people collectively responsible for actions of the state of Israel" constitutes antisemitism.

Escalating Restrictions

This is why we've reached a situation where police authorities can suggest that protests criticizing Israel's policies should be called off because they might "accidentally or intentionally" endorse anti-Jewish sentiment. Similarly, government officials have declared that acknowledgment of Palestinian statehood has made political parties "complicit" in alleged abuse experienced by Jewish communities.

Inconsistent Treatment

On the same day as the synagogue attack, the Israeli military killed numerous of Palestinian civilians in Gaza – increasing the terrible count from 24 months of ongoing violence that have claimed many thousands of lives. British politicians and news organizations have hardly hidden the limited value they assign to Palestinian life. This represents one of the boldest demonstrations of discrimination in our time.

Crossing Thresholds

Our government has already crossed a dangerous threshold by banning Palestine Action, a non-violent, human rights-focused activist collective. Thousands of British protesters have been arrested, primarily for carrying placards against mass killing and endorsing the proscribed group. Many of those detained are elderly citizens; including a retired priest and the daughter of a Holocaust survivor.

Global Comparisons

It's not difficult to see where this trajectory leads. In the United States, political leaders helped vilify demonstrations supporting Palestine: a ex-political leader suggested that some were "connected to" other nations, while the sitting leader characterized such demonstrations as antisemitic. In doing so, they helped legitimize the authoritarian crackdown on such protests – and on free speech in general.

Looking Ahead

If a conservative administration comes to power, it would be granted extensive authority to control opposition. What might a Reform government do with this repressive toolkit? Our ancestors fought, endured hardship and died to secure our liberties. We may ultimately rue how easily we allowed them to be eroded.
